By enrolling in our Monthly Membership Program, you agree to the following terms and conditions. These terms are designed to ensure a safe, enjoyable, and fair experience for all members.<\/p>\n<ol>\n<li>\n<h5>Membership Eligibility<\/h5>\n<ul>\n<li><strong>Age Requirement for Membership:<\/strong> Candidate must be at least 18 years old to own a membership. Participants aged 16 and above can be added as an additional family member using the family plan add on (see section 3).<\/li>\n<li><strong>Age Requirement for Axe Throwing:<\/strong> Ages 7 and under can use a foam axe.\u00a0 This is non-negotiable.\u00a0 With parent permission, ages 8-12 can be tested by a Horse&#8217;s Axe Coach (Axepert).\u00a0 If the coach determines it is not safe, the child can throw a foam axe.\u00a0 The decision of the Coach is non-negotiable.\u00a0 We ask for the parents&#8217; support in our decision.\u00a0 We want to keep your child safe.\u00a0 Ages 13 &#8211; 17 need an adult in the party.\u00a0 All participants ages 17 and under must have a liability waiver filled out by their parent or legal guardian.<\/li>\n<li><strong>ID Requirement:<\/strong> The person with the membership must be present with their ID for the reservation.<\/li>\n<li><strong>Non-Transferable:<\/strong> Memberships are non-transferable.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ol start=\"2\">\n<li>\n<h5>Membership Benefits<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Access:<\/strong> Members enjoy unlimited access to axe throwing lanes during operating hours, subject to lane availability. See Section 5 for Reservation and Usage rules.<\/li>\n<li><strong>Exclusive Events:<\/strong> Members may receive invitations to exclusive events and promotions.<\/li>\n<li><strong>Add-ons:<\/strong> Members can purchase add-ons to customize their account to suit their needs.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>\n<h5>Family Plan<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Add-On:<\/strong> Adding family members to the plan can be done using a monthly Add-on. Family members are immediate family only which includes Spouse\/Significant other and children.\u00a0 Extended family and friends cannot be added to a plan. \u00a0Up to four family members can be added to a single membership plan.<\/li>\n<li><strong>Plan Benefits: <\/strong>Family members share in the benefits of the plan.\u00a0\u00a0 Adding a family member does not increase the benefits.\u00a0 Please see section 5 for reservation rules.<\/li>\n<li><strong>ID Requirement<\/strong>: The person with the membership or added family member must be present for the reservation and show their ID to get the axe throwing lane.<\/li>\n<li><strong>Non-Transferable:<\/strong> Memberships are non-transferable.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li>\n<h5>Membership Fees and Payment<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Monthly Dues:<\/strong> Membership dues plus tax are paid monthly, payable in advance.<\/li>\n<\/ul>\n<p><strong>4.2 Payment Method:<\/strong> Payments are processed via automatic debit or credit card transactions.<\/p>\n<ul>\n<li><strong>Late Payments:<\/strong> A late fee of $15 will be applied to any payments not received within 5 days of the due date.<\/li>\n<li><strong>Non-Transferable:<\/strong> Memberships are non-transferable.<\/li>\n<li><strong>ID Requirement:<\/strong> The person with the membership must be present for the reservation and show their ID to get the axe throwing lane.<\/li>\n<li><strong>Customizable Plans:<\/strong> Plans are built with a base membership price plus add-ons, allowing customers to customize their membership to suit their needs.<\/li>\n<li><strong>Add\/Remove Items:<\/strong> Customers will have the ability to add items to their membership in their membership portal. Removing items from the membership must be done in person at a Horse&#8217;s Axe location.<\/li>\n<li><strong>Online Portal:<\/strong> Members will set up an online portal when signing up for the membership. In the portal, members can make reservations, purchase add-ons, and manage their personal information.<\/li>\n<li><strong>Data Protection:<\/strong> Customer information will not be shared with other companies. Credit and debit card information is not stored by Horse&#8217;s Axe but is securely stored by Stripe, an industry-standard payment processor.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li>\n<h5>Reservations and Usage<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Reservations:<\/strong> A reservation is 1 lane for 1 hour.<\/li>\n<li><strong>Reservations are Required: <\/strong>Members must make a reservation to throw. Reservations must be made using your online portal.\u00a0 If a member walks-in to throw without a reservation they will be asked to make a reservation through their online portal.<\/li>\n<li><strong>Single Reservation Rule:<\/strong> One reservation is allowed at a time. Reservations must be made using your online portal. Once a reservation is complete, a member can use their online portal to schedule another reservation.<\/li>\n<li><strong>Multiple Visits<\/strong>: A member can throw multiple times in a day when lanes are available. Book online in your portal for additional time after your initial reservation has started.<\/li>\n<li><strong>Additional Lanes at the same time as your reservation:<\/strong> If you would like your reservation to be larger than 1 lane for 1 hour, additional people in your party can throw for 20% off regular individual person price.<\/li>\n<li><strong>Reservations Priority:<\/strong> Reservations in the system are given priority over walk-ins. Walk-ins are first-come, first-serve.<\/li>\n<li><strong>Group Size:<\/strong> One lane can score up to 6 people at a time. Bring your friends! Additional people in your party can throw for 20% off regular individual person price.<\/li>\n<li><strong>ID Requirement:<\/strong> The person with the membership must be present for the reservation and show their ID to get the axe throwing lane. Memberships are non-transferable.<\/li>\n<li><strong>No Call No Show:<\/strong> A no-call, no-show for a reservation will result in a $15 fee.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ol start=\"6\">\n<li>\n<h5>Facility Usage and Conduct<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Safety Rules:<\/strong> All members must adhere to safety guidelines, including wearing closed-toe shoes and following staff instructions.<\/li>\n<li><strong>Prohibited Activities:<\/strong> Commercial activities, including personal training of other members, are prohibited unless authorized by The Horse&#8217;s Axe.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li>\n<h5>Membership Cancellation<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Notice Requirement:<\/strong> Cancellations require 30 days&#8217; notice and must be done in person at a Horse&#8217;s Axe location.<\/li>\n<li><strong>Account Modifications:<\/strong> Removing items (Add-ons) from the membership requires 30 days&#8217; notice and must be done in person at a Horse&#8217;s Axe location.<\/li>\n<li><strong>Sign-Up Policy:<\/strong> Cancellations are not accepted on the day of sign-up.<\/li>\n<li><strong>Termination by The Horse&#8217;s Axe:<\/strong> We reserve the right to cancel your membership at any time.<\/li>\n<\/ul>\n<ol start=\"8\">\n<li>\n<h5>Liability Waiver<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Assumption of Risk:<\/strong> Members acknowledge the inherent risks associated with axe throwing and agree to hold Horse&#8217;s Axe harmless from any claims of injury or damage.<\/li>\n<li><strong>Waiver Requirement:<\/strong> All members and their guests must sign a liability waiver before participating in any activities.<\/li>\n<\/ul>\n<ol start=\"9\">\n<li>\n<h5>Code of Conduct<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong>Behavior:<\/strong> Members must conduct themselves respectfully towards staff and other patrons. Harassment, use of profane language, or disruptive behavior may result in membership termination.<\/li>\n<\/ul>\n<ol start=\"10\">\n<li>\n<h5>Text Campaigns<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong> Agreement:<\/strong> All members agree to participate in text campaigns for promotions, member only specials and updates.<\/li>\n<\/ul>\n<ol start=\"11\">\n<li>\n<h5>Amendments and Governing Law<\/h5>\n<\/li>\n<\/ol>\n<ul>\n<li><strong> Changes to Terms:<\/strong> Horse&#8217;s Axe reserves the right to modify these terms and conditions. Members will be notified of any changes at least 30 days in advance.<\/li>\n<li><strong> Jurisdiction:<\/strong> These terms are governed by the laws of the state of Texas.
